I hope this isn’t true, but I’m sure alot of divorce attorneys aren’t necessarily finding what they could be finding by using Facebook evidence. Take a look at the attached article Divorce lawyers missing out on Facebook evidence? from LawyersUSA Online. I like the suggestion of having one’s own legal assistants go online and find out what incriminating information is on the Web anywhere (including social networking sites) about our clients.
I completely disagree with the North Carolina lawyer who states, in this article, “most cases where there is evidence of adultery quickly settle.” Well, maybe in North Carolina, but I wouldn’t say that’s true here in Arizona.
I am going to have to look into preparing written guidelines for my own clients to review their own online presence, including Facebook and Twitter profiles and publishing.
