Standards for Rule 10 representation of children (or acting as a court-appointed advisor)

by Annette Burns on June 8, 2011

When someone is appointed by the court in a custody case pursuant to Rule 10, Arizona Rules of Family Law Procedure, Rule 10 provides three different categories for appointment:  best interests attorney; child’s attorney; or court-appointed advisor.

The Comment to Rule 10 gives further guidance for guidelines for these positions.    The Standards of Representation for best interests attorneys and children’s attorneys can be found at ABAStandardsforRepresentationofChildren

The National Council’s Representation of Children Act, also referenced in the Comment to Rule 10 of ARFLP, can be found Here.
